These Terms of Service ("Terms") govern your access to and use of the website located at https://promasonsupply.com (the "Site") and any products, services, content, or features offered through the Site by Pro Mason Supply LLC, a Kansas limited liability company, doing business as ProMason Supply / Pro Mason Supply ("Company," "we," "us," or "our").
By accessing or using the Site, placing an order, or otherwise interacting with our online store, you agree to be bound by these Terms and by our Privacy Policy, Refund Policy, and Shipping Policy (collectively, the "Policies"), each of which is incorporated by reference. If you do not agree, do not use the Site or purchase products from us.
Our Privacy Policy is available on the Site. Our Refund Policy and Shipping Policy are also posted on the Site and apply to all purchases.

1. OVERVIEW OF THE SITE AND OUR BUSINESS

The Site is an online store operated by Pro Mason Supply LLC. We sell specialty masonry restoration materials and related products, including (without limitation) lime mortars, plasters, cleaners, stains, tools, and accessories. We fulfill orders from our warehouse and may provide general technical selection guidance on the Site to help customers choose products. That guidance is informational only and is not a substitute for professional engineering, architectural, or contractor judgment (see Section 5).

2. ELIGIBILITY; AGE OF MAJORITY; ACCOUNT

2.1 You must be at least the age of majority in your place of residence (and in any event at least 18 years old) to use the Site or make a purchase. By using the Site, you represent that you meet this requirement and have legal capacity to enter into these Terms.
2.2 We reserve the right to refuse service, cancel orders, limit quantities, or terminate accounts at our discretion, including where we suspect fraud, misuse, or violation of these Terms or applicable law.
2.3 If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us promptly at info@promasonsupply.com of any unauthorized use.

3. ONLINE STORE TERMS; PRODUCTS; PRICING

3.1 Product descriptions, images, specifications, availability, and prices on the Site are subject to change without notice. We reserve the right to discontinue any product at any time.
3.2 We make reasonable efforts to display accurate information, including pricing and availability. Errors (including typographical, pricing, or inventory errors) may occur. We reserve the right to correct errors and to cancel or refuse orders placed based on incorrect information, even after an order confirmation has been sent.
3.3 Prices are stated in U.S. dollars unless otherwise indicated. Applicable taxes, shipping, and handling charges are calculated at checkout or as otherwise disclosed. Promotional offers, including complimentary shipping promotions, are subject to eligibility rules, cart terms, and our Shipping Policy, and may be modified or withdrawn at any time.
3.4 We do not guarantee that products or descriptions will be available indefinitely or that the Site will be uninterrupted or error-free.

4. ORDERS; BILLING; PAYMENT

4.1 Placing an order constitutes an offer to purchase. We may accept or decline your order for any lawful reason. Acceptance occurs when we confirm shipment or otherwise expressly accept the order.
4.2 You agree to provide current, complete, and accurate purchase and account information. You authorize us (and our payment processors) to charge your selected payment method for the total amount due, including taxes and shipping.
4.3 Orders may be subject to verification, fraud checks, or quantity limits. We may cancel any order and issue a refund for amounts already charged if we cannot fulfill it.

5. PRODUCTS; TECHNICAL INFORMATION; SDS & LABELS

5.1 General information only. Product pages, selection guides, articles, charts, recommendations, and other technical information on the Site are provided for general educational and product-selection purposes only. They are not engineering, architectural, design, structural, or construction advice, and they do not create a professional services relationship.
5.2 Customer responsibility. You are solely responsible for: (a) selecting products appropriate for your project, substrate, climate, and building conditions; (b) reviewing and following all Safety Data Sheets ("SDS"), product labels, technical data sheets, and manufacturer instructions; (c) complying with applicable building codes, historic-preservation requirements, and local regulations; and (d) engaging qualified professionals (e.g., engineers, architects, or experienced masonry contractors) where needed.
5.3 Color, batch, and appearance variance. Natural and mineral-based materials (including lime mortars, plasters, stains, and similar products) may vary in color, texture, set time, and appearance from batch to batch and from samples, monitors, or photographs. Such variance is not a defect.
5.4 Improper use. Improper selection, mixing, application, curing, storage, or use of products can damage buildings, substrates, finishes, or other property and can cause personal injury. To the fullest extent permitted by law, Company is not liable for consequential building damage, project delays, remediation costs, or similar losses arising from customer selection, use, mixing, or application decisions.
5.5 Hazardous materials. Certain products are or contain chemicals that may be hazardous if mishandled. Always read SDS and labels before use; use appropriate personal protective equipment; and follow storage, handling, and disposal requirements.

6. ORDERS; SHIPPING; RISK OF LOSS

6.1 Shipping terms. Order processing times, carriers, methods, rates, tracking, promotional freight (including complimentary pallet freight where offered), and delivery estimates are described in our Shipping Policy, which is incorporated into these Terms.
6.2 Risk of loss. Unless Company expressly agrees otherwise in writing, risk of loss and title for products pass to you when we deliver the products to the carrier. Delivery to the carrier constitutes delivery to you for purposes of risk of loss.
6.3 Lost or damaged in transit. If products are lost or damaged in transit: (a) you must notify Company promptly (and in any event within the time window stated in our Refund Policy) at info@promasonsupply.com, including your order number and supporting details/photos; and (b) you must also promptly file a claim with the carrier as required by the carrier. Company may reasonably assist with carrier claims but does not guarantee carrier outcomes. Company's obligations for wrong items, Company shipping errors, or manufacturing defects caused by Company are governed by our Refund Policy—not by any absolute disclaimer of responsibility for all loss or damage.
6.4 Inspection. You agree to inspect shipments promptly upon receipt as described in the Refund Policy.

7. REFUNDS AND RETURNS

All purchases are subject to our Refund Policy. In summary, sales are generally final; returns and exchanges for change of mind are not offered; and limited remedies may apply for wrong items, Company shipping errors, manufacturing defects, or certain transit issues as set forth in the Refund Policy. In the event of conflict between a summary on a product page and the Refund Policy, the Refund Policy controls.

8. ACCURACY OF BILLING AND ACCOUNT INFORMATION

If you post comments, reviews, feedback, suggestions, or other content on the Site ("Submissions"), you grant Company a non-exclusive, worldwide, royalty-free, perpetual, irrevocable license to use, reproduce, modify, publish, and display such Submissions for any business purpose. You represent that your Submissions do not violate any third-party rights or applicable law. We may remove Submissions at our discretion. We are not obligated to monitor Submissions but may do so.

We may terminate your access for violating this section.

14. INTELLECTUAL PROPERTY

Product names and trademarks of third parties remain the property of their respective owners.

WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT PRODUCTS WILL MEET YOUR SPECIFIC PROJECT REQUIREMENTS. SOME JURISDICTIONS DO NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES; IN SUCH CASES, THE DISCLAIMER APPLIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
Manufacturer warranties, if any, are between you and the manufacturer and are not expanded by these Terms unless we expressly state otherwise in writing.

16. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, PRO MASON SUPPLY LLC and its owners, officers, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, or for building damage, project delays, or remediation costs arising out of or related to your use of the Site, products, or technical information, whether based on warranty, contract, tort (including negligence), strict liability, or any other theory, even if advised of the possibility of such damages.
TO THE FULLEST EXTENT PERMITTED BY LAW, our total aggregate liability arising out of or related to any order or these Terms shall not exceed the amount you actually paid to Pro Mason Supply LLC for the products giving rise to the claim.
SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS; IN SUCH CASES, liability is limited to the maximum extent permitted by law. NOTHING IN THESE TERMS LIMITS LIABILITY FOR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR OTHER LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

17. INDEMNIFICATION

You agree to indemnify, defend, and hold harmless Pro Mason Supply LLC and its owners, officers, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your breach of these Terms; (b) your misuse of products or the Site; (c) your failure to follow SDS, labels, codes, or professional guidance; (d) your Submissions; or (e) your violation of any law or third-party rights.

18. INFORMAL DISPUTE RESOLUTION

Before filing a lawsuit, you agree to first send a written notice of dispute to info@promasonsupply.com describing the claim and requested relief. We will attempt in good faith to resolve the dispute informally within thirty (30) days after receipt of your notice. This is an informal process only; it is not arbitration and does not waive either party's right to pursue available remedies in court after the informal period, subject to Section 19.

19. GOVERNING LAW; VENUE

These Terms and any dispute arising out of or relating to them, the Site, or your purchases shall be governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Exclusive venue for any lawsuit shall lie in the state or federal courts located in Johnson County, Kansas, and you consent to personal jurisdiction there.

20. FORCE MAJEURE

We are not liable for delay or failure to perform due to causes beyond our reasonable control, including acts of God, natural disasters, epidemic, war, terrorism, labor disputes, supply-chain disruptions, carrier delays, government actions, power or internet outages, or similar events.

21. SEVERABILITY

If any provision of these Terms is held unlawful, void, or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall continue in full force and effect.

22. TERMINATION

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Provisions that by their nature should survive (including ownership, warranty disclaimers, limitations of liability, indemnification, and governing law) will survive termination.

23. ENTIRE AGREEMENT; CHANGES

23.1 These Terms, together with the Privacy Policy, Refund Policy, Shipping Policy, and any other policies or notices posted on the Site, constitute the entire agreement between you and Company regarding the Site and supersede prior agreements relating to the same subject matter.
23.2 We may update these Terms from time to time by posting a revised version on the Site with an updated "Last updated" date. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. Material changes may also be highlighted on the Site at our discretion.
23.3 Our failure to enforce any right or provision is not a waiver. Headings are for convenience only.
